§ 13-110. Nonapproval of license.

  • (a)

    The Clerk shall, upon disapproving any application submitted under the provisions of this Code, retain up to twenty-five dollars ($25.00) or ten (10) percent, whichever is greater, of those fees paid in advance by the person so tendering that fee, provided the applicant is not otherwise indebted to the City, in which case those fees may be used to offset that indebtedness.

    (b)

    When the issuance of a license is denied and any action is instituted by the applicant to compel its issuance, such applicant shall not engage in the business for which the license was refused, unless a license be issued to him pursuant to a judgment ordering the same.
