§ 15-402. Curfew for persons under 18 years of age; exceptions.
(a)
Except as hereinafter provided, no person under eighteen (18) years of age shall idle, play, stroll, or wander about, in or upon the:
(1)
Alleys, roadways and streets;
(2)
Parks, playgrounds or other public grounds;
(3)
Places of amusement or entertainment;
(4)
Public places or public buildings;
(5)
Unoccupied residences or buildings;
(6)
Vacant lots;
(7)
Common areas of apartment complexes; or
(8)
Other unsupervised places
within the limits of the City between the hours of 12:00 a.m. and 6:00 a.m. of the following day of every night and morning of the week.
(b)
Those persons under eighteen (18) years of age excepted from the above provisions shall be those who are:
(1)
Accompanied by his or her parents, guardian or other adult having the care and custody of said minor;
(2)
Engaged upon an emergency errand;
(3)
Engaged in the performance of their employment duties;
(4)
Traveling directly to or from his place of employment and residence;
(5)
Upon legitimate business directed by his or her parents, guardian or other adult having the care or custody of said person;
(6)
In a motor vehicle involved in interstate travel;
(7)
Attending an official school, religious, or other recreational activity supervised by adults and sponsored by the City, a civic organization, or another similar entity that takes responsibility for the minor;
(8)
Going home or returning home without any detour or stop from an official school, religious, or other recreational activity supervised by adults and sponsored by the City, a civic organization, or another similar entity that takes responsibility for the minor; or
(9)
Exercising First Amendment rights protected by the Constitution, such as the free exercise of religion, freedom of speech, and the right of assembly.
