§ 15-405. Harmful substances being possessed, sold, distributed or consumed; exceptions.

  • (a)

    Except as otherwise provided, no person shall deliberately smell, inhale, breathe, drink, take orally or intravenously or otherwise consume any compound, liquid, chemical, narcotic, drug, vegetable or other substance which:

    (1)

    Contains ketones, aldehydes, organic acetones, ether, chlorinated hydrocarbons (e.g., gasoline, glue, fingernail polish, etc.) or some other solvent-releasing toxic vapors; or

    (2)

    Causes or can cause conditions of intoxication, inebriation, excitement, elation, stupefaction, paralysis, irrationality, dulling of the brain or nervous system or otherwise changes, distorts or disturbs the eyesight, thinking process, judgment, balance or coordination of an individual.

    (b)

    It shall be unlawful for any person to possess, sell, distribute or for any person to inhale or ingest any compound, liquid or chemical commonly known as Locker Room or Rush which contains alkyl nitrites (isopropyl nitrite, Butyl nitrites (consisting mainly of isobutyl nitrites) and/or any of its isomer or analogs, or any similar compound, liquid or chemical for the purpose of inducing a condition of intoxication or of distortion or disturbance of the auditory, visual or mental processes.

    (c)

    Persons excepted from the above subsection are those individuals who:

    (1)

    Inhale, breathe, drink or otherwise consume such material or substance pursuant to the direction or prescription of any licensed doctor, physician, surgeon, dentist or podiatrist; or

    (2)

    Consume alcoholic beverages in such place or manner as may be authorized and permitted by either State Law or this Code.
