§ 2-202. Powers of Code Compliance Inspector.

  • Inspectors of the Department of Planning and Community Development shall have the power and authority to:

    (1)

    Order the stopping of construction of any building or structure, or the alteration, repair or wrecking thereof, if such is being done in a careless or reckless manner, or in violation of the provisions of this Code;

    (2)

    Call upon the police and fire departments in enforcing violations of this Code, for violations committed in the presence of the inspector;

    (3)

    Order the disconnection of all gas connections to those residences or businesses which the inspector determines have dangerous gas fittings, and such gas shall remain disconnected until such time as violations on dangerous fittings have been remedied;

    (4)

    Order the discontinuance of water service to any building, structure, or premises being built, used or occupied in violation of this Code, and such water service shall remain discontinued until such time as the violations have been remedied to the satisfaction of the inspector.

    (5)

    Order the disconnection of electric service where improper or defective wiring exists or where electrical construction or equipment has been installed without a required permit.

    (6)

    Enter upon or enter in any building, structure, or premises at all reasonable times so as to inspect all electrical wiring, electrical equipment, plumbing, air conditioning systems, heating systems, or refrigeration systems which are now or may hereafter be installed, or to ascertain the sanitary condition, damage, or structural soundness of that building, structure, or premises.

    (7)

    Recommend that the Council declare a nuisance or request the removal of any building, wall or other structure, which is upon, adjoining or near any street, avenue, alley or public ground, which has become dangerous or insecure or liable to collapse from inherent structural weakness or decay, or from fire damage, or for any other reason becomes a menace to life or property.

    (8)

    Revoke any permit where it is found that there has been a misrepresentation of facts or a violation of this Code.

    (9)

    Require any owner or agent who is constructing with reinforced concrete or structural steel, to supply a noncity inspector satisfactory to the Department of Planning and Community Development, such inspector to continually oversee all work during that construction.

    (10)

    Order the vacation of any habitation which is unfit for occupancy due to damage, decay, dilapidation, unsanitary or unsafe conditions which create a serious health or safety hazard to the occupants or to the public.

    (11)

    Order the closing of any streets and the rerouting of traffic when the City has contracted with any person for the improvement of such street, or that period of time necessary to permit the proper completion of that improvement.

    (12)

    Issue citations for violations of zoning ordinances upon direction of the Director of Planning and Community Development, or his designee, Director of Public Works, City Engineer, Development Coordinator, Director of Planning and Community Development, or his designee, or any agent of any of these officials.
